By downloading, installing, or using the Tend mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
Description of Service
Tend is a mood and habit tracking application that helps users understand patterns between their daily habits and emotional states. All data is stored locally on your device.
User Responsibilities
You agree to:
- Use the App for lawful purposes only
- Provide accurate information when using the App
- Not attempt to reverse engineer, decompile, or hack the App
- Not use the App to harm yourself or others
Subscriptions and Payments
Free Tier:
- Access to create up to 3 habits
- Basic mood tracking and reflections
Premium Subscription:
- Unlimited habits
- Export and download insights
- Advanced pattern analysis
Billing:
- Subscriptions are charged through your Apple App Store account
- Monthly: $4.99/month
- Yearly: $29.99/year
- Free trial: 7 days (if offered)
- Subscriptions auto-renew unless cancelled 24 hours before renewal
- Manage or cancel subscriptions in your Apple Account Settings
Refunds:
- Refund requests are handled by Apple according to their policies
- Contact Apple Support for refund requests
Data and Privacy
- All your personal data (habits, moods, reflections) is stored locally on your device
- We do not access, collect, or store your personal data on our servers
- Deleting the App permanently removes all your data

Intellectual Property
The App, including its design, features, and content, is owned by Tend and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the App.
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:
- The App will be error-free or uninterrupted
- The App will meet your specific requirements
- Any data or insights will be accurate or reliable

Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, or consequential damages
- Loss of data or information
- Any damages exceeding the amount you paid for the App in the past 12 months
Changes to Terms
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify you of significant changes through the App or via email.
Termination
We reserve the right to terminate or suspend your access to the App at any time for violation of these Terms.
Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved in accordance with applicable law.
